Intro & Acceptance
Please read these terms carefully. By downloading, accessing, or using the OmisHub mobile application and related services (the “App” or “Services”), you agree to be bound by this User Agreement (the “Agreement”). If you do not agree, do not use the Services.
1) Who We Are
This Agreement is between you and OmisHub Team (“we,” “us,” or “our”), the provider of OmisHub. Contact: nestore0099@icloud.com.
2) The Services
OmisHub transforms your passion for aromatherapy and handmade crafts into a seamless, organized, and inspiring experience where creativity meets precision and every fragrance tells a story.
Key features may include:
- Build custom recipes (wax types, floral elements, essential oil combinations, ingredients, ratios)
- Capture experiment notes across your creative process
- Track aroma impressions as fragrances evolve over time
- Maintain visual recipe archives to compare formulas and results
Features may evolve over time; we may add, modify, or remove features at any time.
3) Eligibility and Account Registration
Eligibility
- You must be at least 17 years old to use the Services.
Accounts
- You may need to create an account and provide accurate information (name/username/email, as applicable).
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4) Your Content
“User Content” includes content you create, submit, upload, or store through the Services, such as recipes, notes, photos, and customer support messages. You retain ownership of your User Content, subject to the rights you grant in this Agreement.
License you grant us
You grant OmisHub Team a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, and process your User Content solely to operate, provide, maintain, secure, and support the Services and to comply with law and enforce this Agreement.
This license ends when your User Content is deleted from the Services, except where retention is required by law or for legitimate dispute-resolution and enforcement purposes.
5) AI-Assisted Features (Optional)
Some features may allow you to optionally upload text and/or images to generate or enhance content (for example, generating a formatted recipe card, summarizing notes, or creating a one-time output based on your inputs).
- You choose whether to upload content; the Services can be used without AI uploads.
- Processing location: uploads are processed on servers controlled by OmisHub Team (our own servers).
- No third-party sharing: we do not share your AI inputs or generated outputs with any third party.
- Deletion: we delete AI inputs and temporary processing artifacts promptly after processing completes; saved outputs remain until you delete them or delete your account.
- No training/marketing: we do not use AI inputs/outputs to train models or for marketing.
You are responsible for the content you upload and for ensuring you have the rights to use it.
6) Acceptable Use
You agree not to:
- Use the Services in violation of any applicable law
- Infringe or violate the rights of others (including intellectual property, privacy, or publicity rights)
- Upload malware or attempt to interfere with or disrupt the Services
- Attempt to access accounts or data you are not authorized to access
- Reverse engineer or attempt to derive source code except to the extent permitted by law
- Use the Services for abusive, harmful, or fraudulent purposes
We may suspend or terminate access if we believe you violated this Agreement or if necessary to protect the Services, users, or OmisHub Team.
7) Photos, Face Data, and Biometric Information
- OmisHub does not perform facial recognition or biometric identification.
- If you upload a photo for a one-time generation feature, it is processed only to provide the requested result and deleted promptly after processing.
- By default, photos attached to recipes/notes are stored locally on your device unless you enable backup/sync.
- We do not use photos for training models or marketing.
8) Privacy
Our collection and use of personal information is described in our Privacy Policy.
9) Intellectual Property
The Services (excluding your User Content) are owned by OmisHub Team or its licensors and protected by intellectual property laws. You receive a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own lawful purposes, subject to this Agreement.
10) Third-Party Services
The Services may rely on third-party platforms or services (for example, app stores, operating system features, or infrastructure providers). We are not responsible for third-party services not controlled by us.
11) Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” OmisHub Team disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, error-free, or secure operation.
12) Limitation of Liability
To the maximum extent permitted by law, OmisHub Team will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, use, or goodwill, arising out of or related to your use of the Services.
To the maximum extent permitted by law, OmisHub Team’s total liability for any claim arising out of or related to the Services will not exceed the amount you paid (if any) in the 12 months before the event giving rise to the claim, or USD $10 if you paid nothing.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13) Indemnification
You agree to indemnify and hold harmless OmisHub Team from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Content, or your violation of this Agreement or applicable law.
14) Termination
You may stop using the Services at any time. We may suspend or terminate your access if we reasonably believe you violated this Agreement or if required to protect the Services or others.
Upon termination, your right to use the Services will stop. Sections that by their nature should survive (including User Content license, IP, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
15) Governing Law & Dispute Resolution (Binding Arbitration)
To the extent permitted by law, this Agreement is governed by the laws of the jurisdiction where OmisHub Team is primarily established, excluding conflict-of-law rules.
Any dispute arising out of or relating to this Agreement or the Services will be resolved by binding arbitration on an individual basis, and not in a class, consolidated, or representative action, except where prohibited by law. Nothing prevents either party from seeking relief in small claims court if eligible.
16) Changes to This Agreement
We may update this Agreement from time to time. We will update the “Effective Date” when changes take effect. Continued use after changes become effective means you accept the updated Agreement to the extent permitted by law.
